Roger was in an automobile accident and broke his leg, arm and ribs. He
has commenced his rehabilitation, and he sees his long-time doctor, Dr.Stone, on a regular basis.
Roger was a serious cyclist before his injury. He owns a high-end bicycle. Because of his injuries he will not be able to ride for quite some
time. Roger is depressed about his injuries, and gets emotional when
thinking he cant ride his bike. Dr Stone has prescribed anti-depressants
for Roger because of his depression. Dr Stone feels bad for Raj. But,
Dr. Stone is also a cyclist and sees an opportunity to get a great bike. At
Rogers next appointment Dr Stone suggested that he get rid of the bike
so it didnt remind him of his inability to ride. Dr Stone even offered to
buy it from him. Roger was emotional and stressed, and had not slept
much. After thinking about it, Roger agreed. Dr Stone offered $1000 for
the bike and Roger accepted.
Roger now regrets selling his bike to Dr. Stone and wants to get out of
this agreement. The bike is actually worth $3000.
Can Roger get out of the agreement with Dr. Stone (i.e., void the
agreement)? Yes or No. Explain and support your answer with
reference to applicable law and apply the law to the facts.
