Section 8 lists the enumerated powers of the Federal Government and the 10th Amendment states that all powers not mentioned in section 8 are reserved to the states and/or the people. People who oppose expansive federal legislation such as the Affordable Care Act (Obamacare) point to these two provisions, arguing that section 8 specifically limits federal power and the 10th Amendment specifically expands the power of individual states. In other words, the federal government is not authorized under the Constitution to regulate health care and other federal initiatives. Therefore these matters should be left to the states. This same debate occurs over and over again when federal legislation is proposed.
