Question 5 Jeff runs an exclusive holiday resort. He charges RM30,000 per annum. Kevin joined the holiday resort 2 month ago andhe has paid the initial installment of RM15,000 and he has to paysubsequent installments in the last remaining few months of theyear. A few days ago, the City Council made a spot check and foundthat the resort had poor safety features and revoked the license ofthe resort indefinitely. All members were not allowed to use thefacilities in the resort. Kevin is now claiming back his RM15,000that he paid. But Jeff refused to refund the initial installmentstating that he has used the resort facilities and is also claimingthe balance of the RM15,000. Advise Kevin. (Total : 20 marks)
