Aaron runs a business dealing in the import of high end fax machines. He is keen to capture the market in the fastest possible time. He is anxious to get this part of his business to expand by advertising. As part of the advertising campaign, huge posters are placed at selected bus interchanges. The adverts state that there will be a 50% discount on all its fax machines for the first 5 customers. Billy is a customer who sees the posters. He writes to Aaron saying that he wants to buy one fax machine. He posts this letter to Aaron on the 1st of January but it only reaches Aaron on the gth of January. Meanwhile, Ching, another customer, had contacted Aaron and enquired on the price. Aaron said that the original retail price was $1,000.00. Ching had immediately sent an email on the 30th of December to Aaron stating that he will buy one fax machine for the sum of $500.00, which is half the original price. Aaron does not retrieve his email regularly and only sees the email on the 7th of January. In the meantime, Aaron realizes that the fax machines are very popular and sells 5 of these machines to the first 5 customers at $500.00 by the 4th of January. Dave is yet another customer who is interested in the prospect of getting the fax machine. He is told that the first 5 fax machines have already been sold to the first 5 customers. Aaron tells Dave that if he wants the fax machine then he has to pay the full price. Dave is upset. He insists that as per the advertisement, he is entitled to the machine at $500.00. He says that he will buy it at $500.00 from Aaron and that if he hears nothing further from Aaron over the next 7 days, he will consider the machine sold to him at the discounted price. Evan is another buyer keen to purchase the fax machine. Upon learning that he is not one of the first 5 customers, he is very upset. He informs Aaron that he is prepared to buy the machine at $700.00 and that he hopes to hear from him soon. At this point in time, Aaron is left with his very last fax machine in the warehouse and he does not mind selling it at $700.00. He calls Evan on his mobile but no one answers the phone. He leaves a voicemail requesting Evan to return his call. Meanwhile, Foo, who is a good friend of Aaron is prepared to buy the last fax machine. He easily persuades Aaron to sell it to him instead. Just as Aaron agrees, Evan suddenly returns his phone call. Evan had not retrieved his voice mail and does not know Aaron is prepared to sell the drilling machine at $700.00. Evan then tells Aaron that he really needs the fax machine and so he will accept the original price of $1000.00. Advise the parties
